1. The Platform — What We Do and What We Don't

DrivingTests ("we", "us", "our") is operated from the UK by Skyline Europe Limited, a UK company (company number 14853892). At drivingtests.co.uk (the "Platform") we offer our customers a matching platform that helps UK learner drivers find other learner drivers to swap practical driving test dates using the DVSA's official appointment change process.

To be completely clear about what our Platform does and does not do:

  • We match learners who want to exchange test dates — that is all.
  • We do not book, reschedule, or cancel any driving test on your behalf.
  • We do not access, interact with, or connect to any DVSA system.
  • We do not guarantee that a swap partner will be found, or that the DVSA will approve any exchange.
  • We are not affiliated with, endorsed by, or in any way connected to the Driver and Vehicle Standards Agency (DVSA) or the Department for Transport.

We only introduce parties to each other who want to swap their practical driving test dates. Once both parties in a match agree to proceed, it is their individual responsibility to co-ordinate and each contact the DVSA and arrange the swap through official channels. We play no role in that process. We can accept no responsibility for the honesty or integrity of the parties we introduce.

2. Who Can Use the Platform

You must be at least 17 years old and legally eligible to hold a provisional driving licence in the UK to use this Platform. By creating an account, you confirm that you meet these requirements.

You may only hold one account on the Platform at any one time, and you may only list one active test at any one time. Creating duplicate accounts or multiple listings for the same test is not permitted and will result in your account being removed.

3. Your Account

When you create an account, you agree to provide accurate and truthful information — including your name, email address, test booking details, and any other information requested during setup. Providing false or misleading details (for example, a fabricated booking reference or incorrect test date) may, at our discretion, result in immediate account termination and your exclusion from future use of our Services.

You are responsible for keeping your login credentials secure. Any activity that takes place under your account is your responsibility. If you believe your account has been compromised, you must contact us immediately.

4. Fees and Payment

4.1 Free to Join

Creating an account, listing your test, and being matched are all free of charge. You do not pay anything until a swap is ready to go ahead.

4.2 Swap Fee

When both you and your match partner accept a proposed swap, each party pays a one-off fee of £9.99. This fee covers the cost of the matching service, contact exchange, and platform support for that swap.

4.3 Payment Processing

You can pay with your credit or debit card. Payments are processed securely via Stripe. We do not store your card details, on our servers or anywhere else.

4.4 What Happens After Payment

Once both parties have paid, we share each party's contact details (name, phone number, and email address) so that you can coordinate calling the DVSA together. You consent to this exchange of information when you complete your payment for the match we have proposed to you.

4.5 Credits and Failed Swaps

  • DVSA refuses the swap: If you and your match partner both paid and attempted the swap in good faith but the DVSA refused the exchange, we will apply a credit to your account covering the swap fee. This credit will be used automatically on your next swap.
  • Match partner doesn't follow through: If your match partner accepted and paid but then failed to cooperate with completing the swap, we will apply a credit to your account for your next swap.
  • Completed swap: Once a swap has been successfully completed through the DVSA, no credit or refund is available.
  • You changed your mind after accepting: If you accepted a match and paid but then decided not to proceed, no credit or refund is available, as the service (matching and contact exchange) has been delivered.

Credits are applied automatically and do not expire while your account is active. Contact us through the support page in your dashboard if you believe you are entitled to a credit.

5. How Swaps Work — and Your Responsibilities

Here is how the process works, and what is expected of you at each stage:

  • You list your test. Enter your current test date, test centre, and what you're looking for (earlier date, later date, or either). You can also specify preferred centres and an acceptable date range.
  • We find a match. Our matching engine looks for compatible partners — someone whose test date and preferences align with yours. If we find one, we notify both parties.
  • Both parties accept. You have 24 hours to review the proposed match and accept or decline. If either party declines or the window expires, no fee is charged.
  • Both parties pay. Once both of you accept, each party pays £9.99. After both payments are confirmed, we share contact details and you can contact each other.
  • Call the DVSA. Between you, you coordinate who will call the DVSA on 0300 200 1122 to request the swap. Both parties will then receive confirmation from the DVSA.

To be clear, you must contact the DVSA, we do not do this for you.

By using the Platform, you agree to:

  • Provide accurate and up-to-date test booking information.
  • Act promptly on match notifications — make contact with your match partner within the 24-hour window.
  • Follow through in good faith if you accept a match.
  • Contact the DVSA yourself to complete the swap.
  • Update your match status honestly on the Platform after contacting the DVSA.
  • Pay any fees the DVSA may charge for the appointment change — those are separate from our swap fee.

We have no insight into whether the DVSA approves or refuses a swap. We have no ability to influence their decision. The DVSA may refuse a swap for any reason and any refusal is outside our control. We accept no liability for DVSA swap refusals.

6. Your Consumer Rights

6.1 Cooling-Off Period

Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you have the right to cancel a purchase within 14 days without giving a reason. However, by accepting a match and completing payment, you acknowledge that you are requesting immediate performance of the service (contact exchange and swap facilitation). You agree that once contact details have been shared, our service has been fully performed and the cooling-off period no longer applies.

6.2 Satisfactory Quality

Under the Consumer Rights Act 2015, digital content and services must be as described, fit for purpose, and of satisfactory quality. If our Platform materially fails to meet these standards, you may be entitled to a remedy including repair, re-performance, or a refund.

6.3 Unfair Terms

If any provision in these Terms is found to be unfair under the Consumer Rights Act 2015, it will not be binding on you, but the rest of these Terms will continue to apply.

Nothing in these Terms affects your statutory rights as a consumer.

7. Your Use of our Platform Services

On registering on our Platform, You expressly agree not to:

  • Accept a match with no genuine intention of completing the swap.
  • Use contact details shared through the Platform for any purpose other than completing the DVSA swap.
  • Harass, abuse, or threaten any other user of the Platform.
  • Attempt to arrange swaps outside the Platform to avoid paying the swap fee.
  • Create fake accounts, use automated tools to interact with the Platform, or attempt to scrape or reverse-engineer our systems.
  • Use the Platform for any unlawful purpose.
  • Sell, transfer, or share your account with another person.

We reserve the right to suspend or terminate any account that violates these rules, without credit or refund.

8. Our Liability

8.1 What We Are Liable For

Nothing in these Terms limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other matter that cannot be excluded or limited under English law.

8.2 What We Are Not Liable For

To the fullest extent permitted by law, we are not liable for:

  • The DVSA refusing, delaying, or otherwise not approving a swap.
  • DVSA system outages, errors, or changes to their processes.
  • Another user providing inaccurate information or failing to cooperate.
  • Your contact details being used in any way other than for the intended Platform services by the party you ask us to disclose it to.
  • Any costs you incur as a result of a failed swap — including but not limited to driving lesson fees, travel expenses, lost earnings, or DVSA appointment change fees.
  • Any indirect, consequential, or incidental loss arising from your use of the Platform.

8.3 Cap on Liability

Our total aggregate liability to you for any claim connected with the Platform is limited to the total amount you have paid us in the 12 months preceding the claim.

8.4 Service Availability

We aim to keep the Platform available at all times but do not guarantee uninterrupted access. We may carry out planned maintenance from time to time, and we will try to give reasonable notice where possible. If the Platform is unavailable for an extended period (more than 72 consecutive hours) and this directly prevents an active match from proceeding, we will consider applying account credits on a case-by-case basis.

9. Privacy and Your Data

We collect and process personal data in accordance with UK data protection law, including the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. Full details of how we handle your data are set out in our Privacy Policy, which forms part of these Terms.

When you accept a match and both parties complete payment, you explicitly consent to us sharing your name, email address, and phone number with your match partner for the sole purpose of completing the DVSA swap. This information must not be used for any other purpose.

You may request access to, correction of, or deletion of your personal data at any time by contacting us, subject to any legal retention obligations.

10. Intellectual Property

All content on the Platform — including text, design, graphics, logos, software, and the matching algorithm — is owned by Skyline Europe Limited (trading as drivingtests.co.uk) and is protected by applicable copyright, trademark, and intellectual property laws. You may not copy, reproduce, modify, or create derivative works from any part of the Platform, or use it to build a competing product or service.

11. Suspension and Termination

11.1 By You

You may close your account at any time by contacting our support team. If you have an active match in progress, closing your account will cancel that match. No credit or refund is due for any swap fee already paid unless you qualify under the credits policy in section 4.5.

11.2 By Us

We may suspend or terminate your account immediately if you breach these Terms, provide false information, engage in prohibited conduct, or abuse or discredit in any way other users or our staff. In such cases, no credit or refund will be issued. Any active matches may be cancelled.

11.3 After Termination

On termination, your access to the Platform is revoked and your data will be handled in accordance with our Privacy Policy.

12. Communications

By using the Platform, you agree to receive service-related messages from us — including match notifications, account updates, and swap status alerts. These messages are essential to the operation of the service and cannot be opted out of while your account is active.

We may send these notifications via email, WhatsApp, or SMS depending on your contact preferences and what you have opted into. Standard data or messaging rates from your carrier may apply.

We may also send occasional marketing communications. You can unsubscribe from these at any time without affecting your use of the Platform.

13. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or through the Platform before the changes take effect. Your continued use of the Platform after changes have been communicated constitutes your acceptance of the updated Terms. If you do not agree with a change, you should stop using the Platform and close your account.

14. Governing Law and Disputes

These Terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.

Before taking formal action, we ask that you contact our support team first so we can try to resolve the matter informally. If you are a consumer, you may also have the right to use alternative dispute resolution services.

15. General

  • The terms set out on our website, these Terms and our Privacy Policy, represent the entire agreement between you and Skyline Europe Limited (trading as drivingtests.co.uk) regarding your use of the Platform.
  • If any part of these Terms is found to be invalid or unenforceable, the rest will remain in effect.
  • Our failure to enforce any provision does not constitute a waiver of that provision.
  • You may not assign or transfer any rights under these Terms. We may transfer our rights and obligations to another organisation, and we will notify you if this happens.
  • We are not liable for any failure to perform our obligations where that failure is caused by events beyond our reasonable control — including but not limited to changes in DVSA policy, government action, natural or man-made disasters, economic crisis or widespread technical failures.
